The Charging
Division is
responsible for deciding whether criminal charges should be filed against an offender in
adult felony and misdemeanor cases.
Cases usually come to the Charging Division from various law enforcement
agencies. In some cases, private citizens may request that charges
be filed. If you are a person who wishes to request criminal charges
please consult our frequently asked
questions by victims of a crime. After reviewing the cases, the
Charging Prosecutors will make a decision as to what if any criminal charge should
be filed.
When the
Charging Assistant files charges in a felony case, it is thereafter presented to
the grand jury to
seek an indictment. After the indictment, it is then
assigned to a trial attorney. Misdemeanor cases are charged by filing a
charge document called an
information and then assigned to a trial attorney.
The Charging
Division also
handles bond hearings and petitions to revoke probation in misdemeanor cases.
